Sentencings
Richard J. Moore, 31, Tomahawk, was sentenced Dec. 21 for failing to maintain sex offender registry. He was ordered to pay $268 in court costs. According to court records, Moore failed to comply with change of residence notification requirements.

Fred P. Davenport, 18, Milwaukee, was sentenced Dec. 18 for battery by prisoner. Additional counts of battery by prisoner and child abuse were dismissed and read into the record. He was sentenced to one year in prison and two years extended supervision. According to court records, Davenport battered two other youths at Lincoln Hills School in September 2015.

Steven J. Morris, 28, Rhinelander, was sentenced Dec. 22 on charges of battery to a law enforcement officer, resisting an officer-substantial battery, disarming a peace officer and intentionally using oleoersin device on an officer. A count of criminal trespass to dwelling was dismissed and read in to the record. Following a plea agreement, Morris was sentenced to four years prison and two years extended supervision. According to court records, a Lincoln County deputy attempted to take Morris into custody on an arrest warrant Aug. 5, 2015 at a residence on Osero Lane in the Tomahawk area. Morris struggled with the officer, took his pepper spray from him and sprayed the officer in the eyes with it. He then fled the residence. Morris was later located at another nearby residence which he had entered without permission.

Alex M. Ungerer, 19, Wausau, was sentenced Dec. 21 on charges of battery and disorderly conduct. A count of substantial battery was dismissed and read in to the record. Following no contest pleas, he was sentenced to 10 days jail and ordered to pay $243 court costs. According to court records, the charges stemmed from an assault outside a city of Tomahawk residence in May 2015.

James M. Peterson, 47, Stanley, was sentenced Dec. 18 for OWI 7th. Following a no contest plea, he was sentenced to three years prison and two years extended supervision. According to court records, Peterson nearly struck and off-duty Merrill police officer who was shoveling his driveway in January 2015.

Steve C. Montalto, 52, Rhinelander, was sentenced Dec. 21 for resisting/obstructing an officer. Counts of misdemeanor bail jumping and disorderly conduct were dismissed and read in to the record. He was placed on 12 months probation and ordered to pay $243 court costs. According to court records, the charges stemmed from an altercation at a tavern in the city of Merrill in February 2014.

Tim L. Kleinschmidt, 44, Merrill, was sentenced Dec. 21 for possession with intent to deliver amphetamine. Counts of possession with intent to deliver marijuana and possession of drug paraphernalia were dismissed and read in to the record. He was sentenced to 150 days jail, placed on 36 months probation, and AODA was ordered. According to court records, Merrill police stopped Kleinschmidt in the city on February 2014 and found methamphetamine and marijuana in the vehicle.

Marquis J. Rogers, 16, Kenosha, was sentenced Dec. 22 on two counts of prisoner expel/throw bodily substances. Following a guilty plea, Rogers was sentenced to 180 days jail and placed on 30 months probation. According to court records, Rogers threw urine at two staff members at Lincoln Hills School in April 2015.

Nicholas R. Cliver, 26, Merrill, was sentenced Dec. 23 on counts of burglary and theft. Charges of aggravated battery, battery and felony bail jumping were dismissed and read in to the record. Following no contest pleas, he was sentenced to five years prison and four years extended supervision on the burglary charge and a concurrent sentence of three years prison and four years extended supervision on the theft charge. According to court records, Cliver was involved in an armed home invasion robbery in March 2015 at a Tomahawk area residence. Cliver was reportedly armed with a hatchet, which he used to strike one of the residents over the head several times. The residents of the home fought back. Cliver and his two accomplices fled the residence empty-handed. Cliver’s co-defendant in the case, Christopher Mason, was sentenced to prison Dec. 3 on charges of aggravated battery and robbery with use of force. Two other accomplices, Chad Staehle and Dalvin Sanders, have entered no contest pleas to charges related to the home invasion and are awaiting sentencing.
